Terms and Conditions
Bound Medical
Revised October 1, 2026
1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Bound Medical ("Bound Medical," "Company," "we," "us," or "our") concerning your access to and use of https://boundmed.com and any related websites, patient-facing digital services, online forms, messaging features, or other online services that link to these Terms (collectively, the "Site").
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Site.
We may revise these Terms from time to time. The revised Terms will become effective when posted, unless otherwise stated. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
2. MEDICAL SERVICES; NO EMERGENCY CARE
The Site may provide information about medical, wellness, weight-management, hormone-related, peptide-related, telehealth, or other healthcare services offered by Bound Medical or licensed healthcare professionals affiliated with Bound Medical. Website content is provided for general informational purposes and is not a substitute for an individualized medical evaluation, diagnosis, or treatment plan.
Submitting a form, sending a message, creating an account, or using the Site does not by itself establish a clinician-patient relationship. A clinician-patient relationship is established only when applicable clinical, consent, eligibility, and professional requirements have been satisfied.
THE SITE IS NOT AN EMERGENCY SERVICE. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT. DO NOT RELY ON WEBSITE FORMS, EMAIL, CHAT, OR SMS FOR URGENT OR EMERGENCY MEDICAL NEEDS.
3. TELEHEALTH SERVICES AND PATIENT RESPONSIBILITIES
Certain services may be delivered through telehealth. Telehealth involves the use of electronic communications to enable healthcare professionals and patients at different locations to exchange health information and provide care. Availability of telehealth services may depend on your physical location, clinician licensure, clinical appropriateness, technology availability, and applicable federal and state law.
You agree to provide accurate and complete information, including your identity, current physical location when requested, medical history, medications, allergies, symptoms, and other information reasonably needed for care. You are responsible for maintaining a suitable device, internet or telephone connection, and a reasonably private environment for telehealth encounters.
Telehealth has limitations and risks, including technology failures, delays, incomplete information, reduced ability to perform a physical examination, and privacy risks outside Bound Medical's reasonable control. Your clinician may determine that telehealth is not appropriate and may recommend in-person evaluation or other care.
4. HIPAA, PROTECTED HEALTH INFORMATION, AND PRIVACY
Bound Medical is committed to protecting the privacy and security of health information as required by applicable law. To the extent Bound Medical is a HIPAA covered entity, or otherwise subject to HIPAA with respect to particular information or activities, Bound Medical will handle Protected Health Information ("PHI") in accordance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), the Health Information Technology for Economic and Clinical Health Act ("HITECH"), and applicable implementing regulations.
HIPAA's Privacy Rule governs permitted uses and disclosures of PHI and provides individuals with certain rights concerning their health information. The HIPAA Security Rule requires reasonable and appropriate administrative, physical, and technical safeguards for electronic PHI ("ePHI"). Our HIPAA obligations apply according to the nature of the information, the service involved, and our legal role with respect to that information.
Our Notice of Privacy Practices, where applicable, describes in greater detail how PHI may be used and disclosed and how you may exercise rights concerning PHI. If there is a conflict between these Terms and a Notice of Privacy Practices regarding PHI, the Notice of Privacy Practices controls with respect to the PHI issue.
You should not send sensitive medical information through ordinary email, social-media direct messages, or other communication channels that Bound Medical has not designated for clinical or secure communications. When secure patient portals, telehealth systems, or other designated channels are available, you should use those channels for sensitive health information.
5. HIPAA SECURITY SAFEGUARDS AND SERVICE PROVIDERS
Bound Medical uses reasonable and appropriate safeguards designed to protect ePHI and other sensitive information against unauthorized access, use, alteration, loss, or disclosure. Safeguards may include administrative controls, access controls, authentication, workforce practices, technical protections, secure transmission methods, audit or monitoring controls, contingency procedures, and physical safeguards, as appropriate to the systems and risks involved.
Where HIPAA requires a third-party vendor to act as a Business Associate, Bound Medical seeks to use vendors that agree to protect PHI through an appropriate Business Associate Agreement ("BAA") or other legally required arrangement. No internet-based system or method of electronic transmission can be guaranteed to be completely secure, and nothing in these Terms should be interpreted as a guarantee against every security incident.
If Bound Medical discovers an impermissible use or disclosure of unsecured PHI that constitutes a reportable breach under applicable law, Bound Medical will provide notifications as required by applicable federal or state law.
6. USER REPRESENTATIONS
By using the Site, you represent that you have legal capacity to agree to these Terms; the information you provide is truthful, current, and complete; your use of the Site complies with applicable law; and you will not impersonate another person or provide another person's health or identifying information without lawful authority.
If you create login credentials, you are responsible for maintaining their confidentiality and for promptly notifying us of suspected unauthorized access.
7. PROHIBITED ACTIVITIES
You may not use the Site to violate law; gain unauthorized access to systems or information; interfere with security features; introduce malicious code; scrape or systematically collect content without authorization; impersonate another person; submit fraudulent information; harass others; reverse engineer Site software except where permitted by law; or use the Site in a manner that compromises patient privacy, security, or the operation of healthcare services.
8. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and its content, including text, graphics, logos, photographs, videos, software, design elements, and trademarks, are owned by or licensed to Bound Medical and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, revocable, non-exclusive license to access the Site for personal, lawful, non-commercial use.
No Site content may be copied, republished, distributed, sold, licensed, or commercially exploited without prior written permission, except as permitted by law.
9. USER SUBMISSIONS AND COMMUNICATIONS
Information submitted for the purpose of obtaining healthcare, scheduling, billing, or patient support will be handled according to applicable privacy law and our Privacy Policy and, where applicable, our Notice of Privacy Practices. Health information is not treated as a public user contribution.
General suggestions, ideas, or feedback that do not contain PHI or confidential information may be used by Bound Medical without compensation or restriction, subject to applicable law. Do not include PHI in general feedback or public reviews.
10. SITE MANAGEMENT; TERM AND TERMINATION
We may monitor and manage the Site, restrict or suspend access, remove content, address security concerns, and take other reasonable actions to protect patients, users, Bound Medical, and the Site.
These Terms remain in effect while you use the Site. We may suspend or terminate access for misuse, security threats, legal requirements, or violations of these Terms.
11. MODIFICATIONS, AVAILABILITY, AND THIRD-PARTY SERVICES
We may modify, suspend, or discontinue Site features at any time. We do not guarantee uninterrupted availability.
The Site may link to or integrate with third-party services, including scheduling, payment, analytics, communications, pharmacy, laboratory, or telehealth technology providers. Those third parties may have their own terms and privacy practices.
Use of third-party healthcare vendors involving PHI will be addressed in accordance with applicable privacy and security requirements, including BAAs where required. Links to third-party websites do not constitute an endorsement of their content or practices.
12. FEES, BILLING, PRESCRIPTIONS, AND CLINICAL ELIGIBILITY
Prices, fees, membership terms, and payment requirements, if any, will be disclosed through the applicable service or checkout process.
Clinical services, prescriptions, medications, laboratory testing, or treatment are never guaranteed merely because payment has been made or information has been submitted. A licensed clinician must determine whether a requested service or treatment is medically appropriate and legally permissible.
Medication availability, prescribing requirements, pharmacy fulfillment, and treatment options may vary by jurisdiction and individual circumstances. You must follow clinician instructions and promptly report material changes in your health, medications, or symptoms.
13. DISCLAIMER
THE SITE AND GENERAL WEBSITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. BOUND MEDICAL DOES NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.
NOTHING IN THIS DISCLAIMER LIMITS PROFESSIONAL DUTIES OWED BY A LICENSED HEALTHCARE PROFESSIONAL OR RIGHTS THAT CANNOT LAWFULLY BE WAIVED. MEDICAL CARE IS SUBJECT TO SEPARATE CLINICAL CONSENTS, PROFESSIONAL STANDARDS, AND APPLICABLE LAW.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Bound Medical and its officers, employees, agents, and contractors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the Site.
This limitation does not exclude or limit liability that cannot legally be excluded, including any liability or patient rights governed by applicable healthcare, professional-liability, consumer-protection, or privacy law.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Bound Medical harmless from third-party claims arising from your unlawful misuse of the Site, violation of these Terms, infringement of third-party rights, or submission of information you were not authorized to provide.
This provision does not require a patient to indemnify a healthcare professional for the professional's own negligence or other liability that cannot lawfully be shifted.
16. USER DATA; ANALYTICS; TRACKING TECHNOLOGIES
Bound Medical may collect information necessary to operate the Site, respond to inquiries, schedule services, provide care, process payments, maintain security, and comply with law, as further described in the Privacy Policy and, where applicable, the Notice of Privacy Practices.
Analytics, advertising pixels, cookies, and similar technologies must not be used in a manner that unlawfully discloses PHI. Bound Medical's use of tracking technologies is subject to applicable privacy laws and the context in which information is collected. Information collected in a healthcare context may receive protections different from ordinary website analytics data.
Bound Medical does not sell PHI. Mobile opt-in consent and data will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
17. ELECTRONIC COMMUNICATIONS AND SIGNATURES
By visiting the Site, sending electronic communications, completing online forms, or using electronic consent or signature tools, you consent to conducting transactions electronically to the extent permitted by law. Electronic records and signatures may satisfy legal writing and signature requirements.
Electronic communications can carry privacy risks. You are responsible for keeping your email account, mobile device, and other personal communication channels secure. Clinical or highly sensitive information should be sent through designated secure channels when available.
18. SMS MESSAGING TERMS & CONDITIONS
Bound Medical may send SMS messages concerning appointment confirmations, scheduling updates, service reminders, customer support, care-related communications, and, where you have provided any legally required consent, promotional or marketing messages.
You may opt in by providing your mobile number and affirmative consent through an approved method, such as a website form or other documented enrollment process. Consent to marketing text messages is not a condition of purchasing goods or services.
Message frequency varies. Message and data rates may apply.
You may opt out at any time by replying STOP. We may send one final confirmation message.
For assistance, reply HELP or contact Bound Medical at 469-699-4000 or info@boundmed.com.
SMS is not appropriate for emergencies. Depending on the nature of a message and the technology used, text messaging may present privacy risks. Do not send urgent or highly sensitive medical information by SMS unless Bound Medical has specifically instructed you to use that channel.
Mobile opt-in data and consent will not be shared, sold, rented, or disclosed to third parties or affiliates for their marketing or promotional purposes.
19. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies.
Any dispute-resolution provision applicable to medical services, professional negligence, billing, privacy rights, or patient care may be subject to separate patient agreements and mandatory federal or state law. Nothing in these Terms is intended to waive a right or remedy that cannot lawfully be waived.
Any arbitration clause used by Bound Medical should be reviewed by qualified healthcare counsel for enforceability in the jurisdictions where services are provided.
20. MISCELLANEOUS
These Terms, together with policies and agreements expressly incorporated by reference, constitute the agreement governing use of the Site.
If a provision is held unlawful or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law. Failure to enforce a provision is not a waiver.
These Terms govern the Site and do not replace informed-consent documents, telehealth consents, financial policies, medication-specific disclosures, Notice of Privacy Practices, or other patient-facing agreements required for healthcare services.
